Terms and Conditions

Welcome to the Next Hit Maker Independent Artist Music Contest (“Contest”), organized by StayOnBeat, LLC and its subsidiary NextHitMaker.com (collectively referred to as the “Company”). By entering or participating in this Contest, each participant (“Participant”) agrees to comply with and be bound by the following Terms and Conditions. If you do not agree to these Terms and Conditions, you should not participate in the Contest.
1. Eligibility
1.1. The Contest is open to individuals who are at least 18 years old at the time of entry. Participants must be independent music artists without a current major label contract. 1.2. Employees, affiliates, agents, and family members of the Company or any companies involved in the production or administration of the Contest are not eligible to participate. 1.3. Participants must have all legal rights to the music and content they submit, including but not limited to copyrights and trademarks.
2. Contest Entry
2.1. To enter the Contest, Participants must submit their original music and any required documentation through the official NextHitMaker.com website. 2.2. All entries must be submitted within the contest period, as specified on the website. Late or incomplete entries will not be considered. 2.3. Participants are limited to one entry per Contest cycle unless otherwise stated.
3. Submission Requirements
3.1. All music submitted must be the original work of the Participant and must not infringe on the intellectual property rights of any third party. 3.2. Submissions must not contain any offensive, defamatory, or inappropriate content as determined by the Company in its sole discretion. 3.3. The Company reserves the right to disqualify any submission that does not comply with these Terms and Conditions.
4. Judging and Selection of Winners
4.1. Entries will be judged by a panel of independent judges, including celebrity guest judges, selected by the Company. Judging criteria will be based on originality, creativity, and overall artistic quality. 4.2. The decisions of the judges are final and binding. 4.3. The top three winners will receive a cash prize as specified on the Contest website. Prizes are non-transferable and no substitution will be made except at the Company’s sole discretion.
5. Intellectual Property Rights
5.1. By entering the Contest, Participants grant the Company a non-exclusive, royalty-free, worldwide license to use, reproduce, display, distribute, and create derivative works of the submitted music and content for promotional purposes in connection with the Contest and the Company’s activities. 5.2. Participants retain all ownership rights to their submitted music and content, subject to the license granted to the Company in Section 5.1.
6. Publicity
6.1. By participating in the Contest, Participants agree to allow the Company to use their name, likeness, voice, and biographical information in promotional materials without additional compensation, unless prohibited by law.
7. Limitation of Liability
7.1. The Company is not responsible for any incorrect or inaccurate information, technical failures, or any unauthorized access to, or theft, destruction, or alteration of entries. 7.2. The Company is not liable for any injury, loss, or damage of any kind resulting from participation in the Contest or from the acceptance or use of any prize awarded. 7.3. Participants agree to indemnify and hold harmless the Company, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of or related to their participation in the Contest.
8. Disqualification
8.1. The Company reserves the right to disqualify any Participant who violates these Terms and Conditions, engages in unethical or illegal conduct, or attempts to tamper with the Contest process.
9. Governing Law
9.1. These Terms and Conditions are governed by the laws of the State of Florida, without regard to its conflict of laws principles. 9.2. Any disputes arising out of or in connection with the Contest shall be resolved exclusively in the courts located in [Lake County, FL].
10. Amendments and Modifications
10.1. The Company reserves the right to amend or modify these Terms and Conditions at any time. Any changes will be posted on the Contest website, and it is the Participant’s responsibility to review the Terms and Conditions periodically.
11. Privacy
11.1. Personal information collected from Participants will be used in accordance with the Company’s Privacy Policy.
12. Miscellaneous
12.1. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. 12.2. These Terms and Conditions constitute the entire agreement between the Participant and the Company with respect to the Contest.
By participating in the Contest, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
